Embattled High Court judge cited for engaging in acts of corruption to skew justice has described a call from the Criminal Investigations Department on him to assist in investigations as “unconstitutional and unlawful.”
In his latest suit filed at the High Court against Tiger Eye PI as 1st Defendant, Director General – Criminal Investigations Department as 2nd Defendant and the Attorney General as 3rd Defendant, Justice Dery says the call from the CID is an interference of two other cases he has filed over the Anas Aremeyaw Anas expose and Tiger Eye PI.
The writ sighted by tv3network.com indicated that on November 9, 2015, his lawyers received a call from the CID. Parts of the writ says “the Plaintiff further avers that the said invitation by the 2nd Defendant to its office to assist in investigations into the allegations levelled against him by the 1st Defendant is unconstitutional and unlawful…”
It went on further to say “A perpetual injunction restraining the 2nd Defendant from commencing any criminal investigation against the Plaintiff in the exercise of his judicial power in the judgment he delivered in the case: The Republic v. Kwame Dzato”
Mr. Dery is further seeking “A perpetual injunction restraining the 3rd Defendant from commencing any civil or criminal action against the Plaintiff in the exercise of his judicial power in the judgment he delivered in the case: The Republic v. Kwame Dzato.”
Investigative Journalist Anas Aremeyaw Anas went undercover (in a manner that has been criticised) to uncover various acts of corruption which in the judiciary which only used to be a perception.
The expose implicated 34 judges and led to the suspension of 22 others. A judicial committee has been set up to look into the allegations and although a number of the judges have appeared before the committee others have raised disagreements against the entire process.
