Supreme Court adjourns Assin North MP case indefinitely

The Apex court has, on Tuesday July 12, indefinitely adjourned the case involving embattled Member of Parliament for Assin North, James Gyakye Quayson.

The ruling, according to the court, is to allow the defendant to file written submissions to strike out the inherent decision of the highest court of the land.

Private citizen, Michael Ankomah Nimfah had applied to the Supreme Court for the interpretation of Article 942)(a) of the 1992 Constitution following 2020 Parliamentary elections.

“The petitioner is arguing that Mr Gyakye Quayson, at the time of filing his nomination to contest the Assin North parliamentary seat, was holding dual citizenship, contrary to the dictates of the 1992 Constitution.

The petitioner therefore asked the court to declare that the Electoral Commission breached Article 94(2)(a) of the 1992 Constitution when it permitted Mr Quayson to contest in the 2020 elections.”

But presenting his case in court on Tuesday, Counsel for the Assin North MP, Lawyer Tsatsu Tsikata filed a motion for the preliminary objection of the interpretation.

After receiving no objections from the Attorney General’s Department, Counsel for the plaintiff and the Electoral Commission, the court president Justice Jones Dotse adjourned the case indefinitely to allow the defence to file his written submissions within 14 days.

The second and third defendants(Electoral Commission and the Attorney General’s department) are to respond after service.
