Mr Owusu Afriyie, popularly known as Sir John, said inasmuch as he is happy the state filed a nolle prosequi on the alleged rape case, state resources have been wasted.
“The Attorney General knew that they were going to waste the state’s resources and time and energy and money in insisting that they were going to prosecute.”
Speaking on TV3’s News in Brief on Thursday, April 23, Sir John advised the state attorneys “not to prosecute for prosecution sake.
“But that any case that the state takes to court, they must be satisfied that they get conviction.”
The state requested the Accra High Court on Wednesday, April 22 to discontinue the case.
The Court granted its request by discharging Mr Darkwah, popularly known as KKD.
“For the sensibilities of this matter, I believe it was right for the Attorney General to file a nolle prosequi,” Sir John indicated, suggesting that the victim would have been taken through a rigorous cross-examination by the defendant, a situation that would have opened a can of worms.
“From the word go, this 19-year-old lady had insisted that she was not prepared to give any evidence in this matter.”
Sir John was, however, concerned Ghana’s laws do not enjoin the AG to adduce reasons anytime he or she enters a nol. pros.
She didn’t in the recent cases in the cocaine trial, he said, but in this case she did.
