Sacked Jasikan Circuit Court judge sues Chief Justice, Judicial Service

The Jasikan Circuit Court judge who was removed for alleged misconduct, Alfred Kwabena Asiedu, has sued the Judicial Service and the Chief Justice Gertrude Torkornoo for his removal.

He is seeking a declaration that his removal was unlawful.

The reliefs he’s seeking include: “A declaration that the removal of the Applicant from office as a Circuit Court judge as contained in the letter signed by the 2nd Respondent dated I3th November 2023 is unlawful.”

 

“A declaration that both the Disciplinary Committee and the Judicial Council acted ultra vires when they made a finding of malicious prosecution against the Applicant, and a declaration that the said findings of the two bodies are patent error of law on the face of record and same liable to be quashed by the supervisory powers of this Court.”

 

Background

Gertrude Torkornoo sacked Mr Alfred Kwabena Asiedu for misconduct in a divorce case that he presided over.

This was after the disciplinary committee that investigated him for having an amorous  with a woman in the divorce petition which was pending in his court found him to have misconducted himself.

A petition accusing Justice Asiedu of abuse of , sexual exploitation, malicious , and impropriety was presented by one Singari Diana Sadia on January 16, 2023.

Upon receiving the petition, the Chief Justice, forwarded it to the disciplinary committee of the  Service for .

The committee after thorough scrutiny, recommended the dismissal of Justice Asiedu,

The Chief Justice of , Justice Gertrude Torkornoo, in a letter dated November 13, 2023 said “The Disciplinary Committee, after investigating the above-mentioned matter, found that you misconducted yourself as a Judge as there was ample evidence that you were involved in an improper relationship with the Petitioner, who had a Divorce case pending before you.

“The Disciplinary Committee also established the allegation of abuse of power and malicious prosecution against you as you were found to have caused the  and prosecution of the Petitioner without justification. The Disciplinary Committee consequently recommended that you should be dismissed.”
