He said parties to the case knew that a ruling by the Supreme Court on Tuesday, July 27 directed that due processes are followed to transfer the case to the apex court of Ghana for hearing.
Speaking to journalists after presiding judge Justice Kwasi Boakye ruled against James Gyaakye Quayson for holding dual citizenship at the time of the elections, Mr Ofosu Ampofo said the NDC and its lawyers were taken by surprise by the action of the judge.
“We were at the court premises as early as 8:00am,” he told journalists in Twi. “But try as our lawyers did to file the motions as per the directives of the Supreme Court, the registrar at the Cape Coast High Court locked up his offices until 9:00am.
“We tried all other means to access the registrar but all proved futile.”
He said even the cashiers appeared to be complicit in this as they were also nowhere to be found for even payment to be made if the motions were filed.
“At 9:00am when we were finding all means to get these court officials to file those processes, the judge was in the chamber to pronounce judgement on the case when our lawyers and even representatives of the MP, against whom the petition was filed, were not available.”
He alleged that it may have been deliberate on the part of the judge to stop us from filing the processes on Wednesday.
Already, a member of the campaign team of NDC’s 2020 Presidential Candidate, Alex Segbefia, has hinted that the party will head to the Supreme Court for ruling on the High Court’s judgement.
“If they nominate a judge to be in any position when does he become judge? At the point of nomination?
“It is when he is sworn in so there are three separate dates and this is a matter we think the Supreme Court has to actually rule on.”
