Court rejects ACP Agordzo's request to be released

The Kaneshie District Court has rejected the move by lawyers for ACP Dr. Benjamin Agordzo to have him released after the state substituted a new charge sheet for the earlier one. The court took the decision after Martin Kpebu counsel for the embattled Assistant Commissioner of Police, asked the court to release his client because the state substituted the old charge sheet. According to him, since the state has presented a new charge sheet, it does not affect his client immediately but he has to be released and invited or re-arrested and be taken through the necessary procedure. The state prosecutor objected to the oral application and argued that the defence counsel’s submission was not founded in law. The prosecutor, ASP Sylvester Asare further argued that he was substituting the charge sheet to consolidate the two cases which both have to do with an alleged coup plot and not in the process of acquittal. In her ruling, the magistrate, Eleanor Kakra Bans Botwe, stated that conventions and law does not show that prosecution has gone against the law. The ruling therefore gave prosecution the opportunity to present a new charge sheet which was consolidated. The charges still remain as treason, felony and abetment to commit crime.
