Presided over by Justice Arkaah-Boafo, the Court on Wednesday, November 4 said the suit was “premature”.
Mr Oppong Kyekyeku had sued the party together with its Council of Elders Chairman, C. K. Tedam, and Council of Elders member Most Reverend Dr Asante Antwi over the indefinite suspension handed Mr Afoko.
Among the reliefs sought by the plaintiff is an order of perpetual injunction on the Council of Elders not to hear any complaint against the party’s chairman.
But dismissing the suit, Justice Arkaah-Boafo said internal processes of redress must be exhausted by any member of an organization before heading to the law courts.
He, therefore, upheld submissions made by NPP’s solicitor Godfred Dame in court on Wednesday.
In the decision of his suspension on October 23, Mr Afoko – who still holds himself as chairman of the party – has been given a 21-day period to file an appeal.
