GBA demands release of President Mahama’s prima facie decision on Chief Justice

President Mahama declares Monday, March 31, and Tuesday, April 1, 2025, as public holidays for Eid-Ul-Fitr.

The Ghana Bar Association (GBA) is calling on President John Dramani Mahama to make public the full decision that established a prima facie case against the Chief Justice.

This call was made in a resolution passed at the GBA’s 2025 Mid-Year Conference held at the Labadi Beach Hotel in Accra on April 26, 2025.

The GBA in a statement, emphasized that the release of this decision is crucial for ensuring transparency and fairness in the ongoing proceedings. The association believes that disclosing the President’s determination, which analyzed the petition and outlined the reasons for his conclusion, is consistent with established legal precedent.

In their resolution, the GBA also reiterated its stance on the suspension of the Chief Justice. The association views the suspension as unconstitutional, arguing that the President, who is not a judge or judicial officer, exercised his discretion under Article 146(10) of the 1992 Constitution without the backing of a published Constitutional Instrument, Statutory Instrument, or Regulation, as required by Article 296 of the Constitution.

The Ghana Bar Association calls upon the President of the Republic of Ghana to immediately release the full decision establishing a prima facie case against the Chief Justice, consistent with established precedent,” the statement read.

Furthermore, the GBA in its statement advocates for the immediate enactment of clear and comprehensive regulations pertaining to matters under Article 146 of the Constitution. The association believes that such regulations are necessary to guarantee transparency, accountability, and fairness in all proceedings involving Superior Court justices, particularly in cases related to their potential impeachment or removal.

The Ghana Bar Association also used the occasion to denounce unsubstantiated political commentary or statements aimed at undermining the authority, independence, and integrity of the Judiciary.
