One of the judges implicated in the country’s scandalous judicial corruption has embarked on what could be termed as a suing spree, in an attempt to extricate himself from the quagmire.
Justice Gilbert Ayisi Addo, who has been suspended as a High Court judge, on Monday issued the first of three suits against Anas Aremeyaw Anas and his Tiger Eye PI team whose two-year painstaking work culminated in a three-hour edited video in which some 34 judges were captured allegedly taking bribes.
His lawyer, Nii Kpakpo Samoa Addo, has hinted of initiating two more legal action, including a defamation case, against Anas and his team who have since the public release of the video on September 23 come under all forms of attacks.
“We hold his instructions to file two other writs within the next seven days. One is a defamation writ against the petitioner [Tiger Eye PI] where we will be claiming maximum damages for defamation and another in the Supreme Court,”
He, however, did not give details on the two other suits, except to say that Justice Ayisi Addo “will be challenging each and every allegation in the petition in the defamation suit”.
Justice Ayisi Addo thus becomes the second judge in the case after Justice UP Dery to embark on suing spree. Justice Dery has since the incident, filed multiple suits from the High Court to the Court of appeal.
In view of his ongoing legal battle with Anas, Tiger Eye PI, some media houses including another High Court judge hearing one of his cases, Justice Dery has been excused in appearing before the Judicial Committee hearing the matter.
Interestingly, both Justice Ayisi Addo and Justice Dery are being handled by the same lawyer, Nii Kpakpo Samoa Addo.
In Justice Ayisi Addo’s first suit, he is challenging the validity investigative video and the subsequent actions taken by the Chief Justice and the Attorney General that led to his suspension.
Justice Ayisi Addo argues in the writ dated November 16 “that the audio visual recordings and its transcripts were procured through fraud by the Tiger Eye PI with the sole aim of incriminating” him.
The judge, who is currently on suspension argues that content of the said video constitute an entrapment, hence intolerable in law.
He is contending that the allegations in the petition filed by Anas Aremeyaw Anas’ Tiger Eye PI against him raises issues of alleged criminal conduct on the part of the Plaintiff.
He adds that per the country’s constitution, it is only a court of competent jurisdiction that can “make a determination as to whether any person is criminally liable for any offence or act”.
Justice Ayisi Addo argues that the Chief Justice per article 146 of the constitution, is not a court of competent jurisdiction to make a prima facie finding of criminality against him
In view of these and other arguments, the suspended judge is seeking a total of 29 declarations and three damages against Tiger Eye PI, the Chief Justice and the Attorney General.
